Attorney General Derek Schmidt asks Kansas Supreme Court to stay DUI rulings

Kansas Attorney General Derek Schmidt has asked the Kansas Supreme Court to delay enforcement of four landmark decisions last week that found criminal punishments for refusing sobriety tests are unconstitutional.

On Feb. 26, the state’s high court ruled 6-1 in State v. Ryce and three companion cases that criminal punishments for refusal violate the Fourth Amendment and Fourteenth Amendment to the U.S. Constitution.
