Rare decision by full Kansas Court of Appeals in abortion case fueled first-ever tie vote

When 14 judges of the Kansas Court of Appeals announced Jan. 22 they had split 7-7 on whether the Kansas Constitution guarantees the right to an abortion, it was the first even split in the court’s history.

An analysis of the court’s opinions dating back to its founding in 1977 reveals the court rarely meets in full, as it did in the abortion case, and never had a tie vote before last month.
